Terms and Conditions

1.1 Agreement to Terms

By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1.2 Age Requirements

You must be at least 13 years old to use the App. If you are under 18, you confirm that you have obtained permission from your parent or legal guardian to use the App.

1.3 Capacity

You represent and warrant that you have the legal capacity to enter into these Terms and that your use of the App will not violate any applicable laws or regulations.

2.1 Account Creation

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password for your account
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with others
• Log out of your account at the end of each session

2.3 Account Termination

You may delete your account at any time through the App settings or by contacting us. We may suspend or terminate your account if you violate these Terms.

3.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

3.2 Restrictions

You agree not to:

• Modify, adapt, reverse engineer, or create derivative works of the App
• Use the App for any commercial purposes without our written consent
• Attempt to gain unauthorized access to the App or our systems
• Use the App in any way that violates applicable laws or regulations
• Upload or transmit any harmful code, viruses, or malicious software
• Interfere with or disrupt the App or our servers
• Abuse, overload, or misuse the AI Assistant, including automated or excessive requests intended to disrupt the service or circumvent intended use

3.3 AI Assistant Usage and Fair Use

The Cokora AI Assistant (currently in beta) is provided to help you track, understand, and discuss your baby's care. To keep the service reliable and fair for all users, you agree to the following:

• You will use the AI Assistant only for personal, lawful, and intended parenting-related purposes
• You will not use the Assistant to generate spam, harass others, attempt to extract system prompts, or otherwise abuse the service
• You will not use bots, scripts, or automated tools to send messages through the Assistant unless we expressly permit it
• We may monitor usage patterns to detect and prevent abuse, fraud, or activity that degrades the experience for other users
• We may limit, throttle, suspend, or restrict your access to the AI Assistant or LLM chat features at any time, with or without notice, including daily or monthly message limits, rate limits, or temporary suspensions, to prevent abuse, manage costs, maintain service quality, or for any other operational reason
• We may modify, pause, or discontinue AI Assistant features at any time, including during the beta period

Any limits on AI Assistant usage may apply per account, per device, or per household, and may change at our discretion. Repeated or serious abuse may result in account suspension or termination under Section 2.3.

3.4 AI Assistant Outputs and Your Responsibility

The AI Assistant generates responses using artificial intelligence. We work hard to make those responses helpful, accurate, and appropriate, but AI outputs can be incomplete, outdated, or incorrect. They are provided for general informational and educational purposes only and are not medical advice, diagnosis, or treatment.

You are solely responsible for how you use the Assistant's outputs. This includes any decisions you make, actions you take, or information you rely on based on a response from the AI Assistant. You must use your own judgment and, where appropriate, seek advice from qualified professionals such as your paediatrician, lactation consultant, or other healthcare provider before acting on AI-generated guidance.

To the fullest extent permitted by law, Cokora is not liable for any loss, harm, or damage arising from your use of, or reliance on, AI Assistant outputs. By using the Assistant, you accept that you alone are responsible for evaluating its responses and for any consequences of acting on them.

7.1 Free and Paid Features

The App may offer both free and paid features. Paid features require payment of applicable fees as described in the App.

7.2 Payment Terms

• All fees are in Australian Dollars (AUD) unless otherwise specified
• Payments are processed through third-party payment providers
• Subscription fees are charged on a recurring basis until cancelled
• You authorize us to charge your chosen payment method for all applicable fees

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia.

12.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Western Australia, Australia.
